Terms and Conditions

• Client
  Where used in these terms and conditions, "Client" refers to the client who signs the written offer and/or all clients on whose behalf it is signed.
• Bookings
  Bookings can only be made by a written confirmation (e-mail, fax or letter). The Client signing the booking confirmation or sending it by email warrants that he/she has the authority of the persons/guests therein designated, whether by name or not, to make the booking on their behalf subject to the terms and conditions contained herein.
• Confirmation of Bookings
  The validity of bookings is subject to a written confirmation notice and invoice from VIP Sportstravel AG.
• Payment Methods
  Only payments by bank remittance are accepted. All payments sent to VIP Sportstravel AG must include package name, invoice number and company name to ensure payment is matched to the Client's booking.
• Late Payments
  If payments are not received by the dates stipulated in the payment schedule, VIP Sportstravel AG can add a late payment fee of 3% of the amount due.
  If the Client doesn’t pay after having received our reminder, VIP Sportstravel has the right to cancel the booking and to invoice cancellation fees according to the due deposits.
• Cancellation by the Client:
  Booking cancellation by the Client has to be sent to VIP Sportstravel AG in writing. Cancellation fees will be charged according to the payments terms communicated
  to the Client in the final offer. The paid deposits will not be refunded in any case. Cancellation of tickets will be charged with 100 % of the ticket costs.
• Cancellation by VIP Sportstravel AG
  a) VIP Sportstravel AG reserves the right to cancel or modify bookings in certain cases, subject to its Terms and Conditions. This may occur for example in cases
  of force majeure, epidemics, strike etc. Most changes are minor but if it is a significant change VIP Sportstravel AG will offer the client the following alternatives
  - an alternative travel arrangement and/or schedule of similar standard and price
  - travel arrangement of lower standard at a lower price (difference in price will be refunded)
  - cancel the holiday. In that case all payments will be refunded.
  b) VIP Sportstravel AG reserves the right at its sole discretion to refuse or cancel any booking or terminate the arrangements if the Client gives reason to do so by acts or omissions. Any paid deposits will be refunded. Further requirements of any kind are excluded subject to cancellation fees or compensation claims.
  c) For the EURO 2012™ in Poland/Ukraine, UEFA and their accommodation service provider reserve a special right to cancel rooms prior to the tournament without giving any reasons. VIP Sportstravel AG therefore reserves, in this particular case, the right to cancel rooms and/or facilities, but where it does so and where the client is not in breach of this sales agreement, VIP Sportstravel AG shall offer the client either a refund of the rates paid to date or offer, if available, replacement accommodation and/or facilities of equivalent or closely equivalent standard and price. Where the client chooses an option of replacement accommodation and/or facilities the terms & conditions will still apply to the booking and VIP Sportstravel will issue an updated booking confirmation to the client.
• Modification of Itinerary
  VIP Sportstravel AG is authorized to modify the itinerary, the order of the succession of the itinerary and the activities, namely before the booking, after conclusion of
  the contract as well as during the tour in case of “Acts of God”, regulatory sanctions or other non predictable or unavoidable incidences which complicate and
  endanger the tour.
• Flights
  Sometimes airlines change their schedules which in that case unfortunately we can’t control. Due to that all flights are subject to change at any time.
  VIP Sportstravel AG can’t take responsibility for any involuntary changes made by airlines or other suppliers, which may affect the flight schedule.
• Price and Validity
  a) All prices quoted are based on tariffs and exchange rates valid at the time of quotation and are subject to increase without any prior notice. We will do everything
  within our control not to adjust prices and will generally only amend prices in cases of marked fluctuations in exchange rates, fuel costs and other operating costs.
  VIP Sportstravel AG reserves the right to modify prices up until 3 weeks prior to departure, particularly in regards to modifications of various air-, seaport and
  governmental taxes and other operational fees (e.g. fuel costs) which are imposed to VIP Sportstravel AG, respectively its service providers (e.g. airlines) or
  increase in the exchange rates which may take place prior to touring. The client will be informed by VIP Sportstravel AG, nevertheless rates can thus be modified
  without warning or prior consultation whether or not the Client has already made full payment. If the package price rises by more than 10% the Client has the possibility to cancel the trip and all payments will be refunded. b) It should be noted that certain taxes are paid directly on departure from the airport of the country concerned. Passport and visa fees, travel insurance, excess baggage charges, airport taxes, gratuities to leaders and guides, extra meals, laundry, drinks, medical expenses, optional activities and trips, and any items of a personal nature which are not explicitly comprised in your booking are not included in your tour price.
• Trip Termination by the Client
  In case of premature termination of the journey by the Client, VIP Sportstravel AG has no obligation to refund any costs. Additional costs for transport or accommodation are fully covered by the Client.
• Unused Package Services
  No refund can be made for unused services, for unused transportation, sightseeing trips, meals or tickets or for voluntary modifications made by the Client.
• Rooms
  Accommodation in all hotels, whatever the rating, is in standard rooms (sometimes named superior/deluxe rooms) based on twins or doubles (e.g. queen-size, king-size beds) unless otherwise stated.
• Tickets
  VIP Sportstravel AG will not be held responsible for the loss, theft, destruction or misplacement of any tickets regardless of the reason. Tickets are handed out only after full payment. VIP Sportstravel AG reserves the right to change the category of the ticket and to refund or invoice the balance.
• Frequent Flyers
  VIP Sportstravel AG will endeavour to pass on frequent flyer numbers to the airlines, but where more than one carrier is involved with the flight itinerary, VIP Sportstravel AG will take no responsibility that the frequent flyer numbers will be passed on by the appropriate airlines. VIP Sportstravel AG recommends retaining all boarding passes in the event that they are required to prove accumulated frequent flyer points.
• Client’s Address
  VIP Sportstravel AG prefers to use the address of the Client when sending out tour documents.
• Passport & Visa
  VIP Sportstravel AG is not responsible for passport, visa requirements, entry, health or other requirements of the countries visited or for any loss sustained by
  the Client for failing to comply with laws, regulations, orders and/or requirements of countries visited.
• Luggage
  Luggage and personal effects are at Client’s own risk. It is stressed that VIP Sportstravel AG cannot accept responsibility for any loss or damage to Client's personal luggage or effects from any cause whatsoever, even though handled by VIP Sportstravel AG servants or agents and it is recommended that luggage be insured for the duration of the tour.
• Medical Insurance
  All Clients must be in possession of a valid medical insurance.
• Securing payments made by the Client
  VIP Sportstravel AG’s membership with the Swiss Foundation "Garantie du Voyage" secures the clients payments for the bookings.
• Liability of VIP Sportstravel AG
  VIP Sportstravel AG is responsible for:
  - Conscientious preparation of the travel arrangements
  - Diligent selection of the service providers
  - Correctness of the service descriptions
  - Professional organisation and reservation of services
  VIP Sportstravel AG is liable within the limits of these Terms & Conditions, the legal regulations, international treaties and national laws.
• Limitation of liability
  The liability of VIP Sportstravel AG for damages other than personal injury is limited to twice the amount of the tour price, provided that the damages are neither intentional nor due to gross negligence on the part of VIP Sportstravel AG.
• Disclaimer
  VIP Sportstravel AG is not liable if the cause of non-performance, improper fulfilment or the damage can be traced back to the following reasons:
  - Failures of the Client before or during the tour
  - Non-predictable or unavoidable incidents caused by third parties who do not participate in the contractually agreed services
  - “Acts of God” or an incident which was not predictable or unavoidable despite all due care and attention by VIP Sportstravel AG
  In all these cases all claims and liability of damages are excluded.
• Claims
  Any abnormal incidents including injuries, service problems, cancellation of a service or dissatisfaction must be reported to VIP Sportstravel AG during the journey to allow us an opportunity to rectify the situation or provide assistance. If for any reason the Client is still unsatisfied, the Client must obtain written confirmation by the supplier and follow this up by writing to VIP Sportstravel AG with detail of the complain. Any claims accompanied by supporting documentation must be received in writing within 30 days of the tour completion.
• Applicable Law and Jurisdiction
  The contractual relationship between VIP Sportstravel AG and the Client is subject to the material laws of Switzerland. In case of dispute, VIP Sportstravel AG and the Client undertake to try to settle such dispute out of court or before the ombudsman of the Swiss travel industry. If not otherwise set forth by mandatory law, any legal dispute in connection with the contractual relationship between VIP Sportstravel AG and the Client shall be submitted to the exclusive jurisdiction of the competent courts at the seat of VIP Sportstravel AG, Zurich, Switzerland.
